Confirmatory Adoption (Same-Sex, LGBTQ+ Parents)
Even if you are married and both parents’ names are on your child’s birth certificate, a confirmatory adoption goes further in protecting your legal relationship with your child and is recommended by such organizations as the National Center for Lesbian Rights (NCLR), Gay and Lesbian Advocates & Defenders (GLAD) and Lambda Legal. A Confirmatory Adoption order provides these important protections:
If your family travels or moves outside of Wisconsin where different laws on legal parentage may apply, a Wisconsin confirmatory adoption order will be honored and given Full Faith and Credit (recognition and acceptance of other states' public records, judicial proceedings, and legislative acts), as required by the U.S. Constitution.
If the Wisconsin legislature changes the law regarding parentage in the future, a court order of confirmatory adoption will freeze time and will survive the changes in the law.
If a biological parent, family member or donor challenges your family in court, an adoption order will provide much stronger protection than just a birth certificate.
Adoptions of Wisconsin can provide the required confirmatory adoption screening, which includes an interview by a social worker in your home, background checks, and collecting the required documents. Adoptions of Wisconsin will prepare the required report to be filed with the court.
